In-Person Events & Dark Sky Excursions
(1) Service Guarantee
After-Hours Astronomy Inc (“AHA”) is committed to delivering services that meet the highest standards of quality and professionalism. We guarantee that all services provided by the Company will be performed with due skill, care, and diligence, consistent with industry standards and best practices.
However, After-Hours Astronomy Inc cannot and does not guarantee specific results or outcomes stemming from these services. The results of astronomy and astrophotography endeavors are inherently variable and may be influenced by factors outside our control, including but not limited to customer equipment, environmental conditions, user experience, and the unique configurations of individual setups.
By engaging with our services, you hereby acknowledge and accept that while our team will do everything reasonably possible to ensure quality service delivery, the achievement of any particular goal or result cannot be assured due to the highly individualized and technical nature of astronomy and astrophotography setups.
(2) Payment
For orders completed online payment will be collected at the time of placing your order.
For orders to be paid using an invoice, payment is due within ten (10) days of completion of this contract, or within 48 hours of the event (whichever comes first).
AHA reserves the right to void any contracts and/or cancel any events that have not been paid in a timely manner as outlined here.
(3) Cancellation Policy:
7 days notice or more = Reschedule for free -OR- cancel for a 90% refund
Less than 7 days notice = Reschedule for $250 -OR- cancel for a 50% refund
No cancellations or refunds available with less than 48hr notice. The two exceptions to this are as follows:
Exception A - In cases of severe weather events, which happen often-enough here in Colorado, then After-Hours Astronomy Inc reserves the right to cancel the event or the excursion with less than 24 hours notice. But in any such unfortunate circumstance, After-Hours Astronomy Inc will offer a full refund or free rescheduling at your convenience.
Exception B - After-Hours Astronomy Inc reserves the rights to terminate any event or service deemed to be unsafe or hostile. This can be due to either hostile/aggressive personnel and guests, or (2) due to physical dangers or other safety/security concerns that may be present at in-person event locations. In such cases any refunds would be at the discretion of After-Hours Astronomy Inc.
Changes & Alterations - Changes to any event cannot be guaranteed after this contract is signed, but AHA will do everything in its power to accommodate any reasonable changes. Any additional services added will be paid via separate invoice unless stated otherwise.
(4) Image Release:
By attending this event, you acknowledge that images or recordings which may include your likeness could be taken, and that images of your equipment along with any astrophotography from the event may be shared. You give AHA permission to use these images at the company’s discretion, for purposes including but not limited to social media, websites, and marketing materials.
Intended Uses: These images may be shared or published by AHA for retail, promotional, educational, or informational purposes, including on printed materials, social media, company websites, and advertising campaigns.
Attribution: AHA will credit the original astrophotographer whenever feasible. If you prefer not to receive credit or not to have specific images used, please notify AHA and we will accommodate your request.
Compensation: There is no compensation or royalties for the use of any images in which your property or images may be used.
Your Rights: If at any point you do not want any personal images to be used, you may inform AHA in writing, through our Contact Form, or by email using the address [afterhoursastronomy@gmail.com]. We will always make all reasonable efforts to honor your request and omit you from any image use and/or to remove any published images of you when feasible.
(5) Liability Waiver
Please carefully read the following terms and conditions before joining us for any in person events. This waiver is legally binding and affects your rights, so please ensure you fully understand its contents before proceeding with any After-Hours Astronomy (“AHA”) events:
Release of Liability: By reserving, purchasing, and/or participating in any AHA event, you (the party agreeing to these terms) hereby waive any and all claims against AHA you may have now or in the future. You release AHA from all liability and agree not to sue AHA its officers, agents, representatives, employees or contractors for any personal injury, death, property damage, or loss sustained by you as a result of your participation in any events organized by AHA , without limitations, including in cases of negligence on the part of AHA , its staff, partners, or other participants. I further agree that if I violate this agreement and attempt to bring suit against any part of parties named herein, that I will be held responsible for attorney’s fees and any costs incurred by that person in defending such action.
Assumption of Risk: You voluntarily assume full responsibility for your actions and any consequences arising from participation, including the handling of your own equipment and adherence to all safety instructions and event guidelines. You agree that AHA is not responsible for any damage to or loss of your personal property or equipment during the course of the event, regardless of cause. In the case of private events where it would be impractical for all guests to sign this waiver, you (the host) agree to assume the risk for your guests and their actions.
Damages and Responsibility for Equipment: AHA will provide training, clear safety precautions, and printed safety guidelines with each telescope setup or package. By participating in this event you hereby agree to assume responsibility for any damages to equipment owned, rented, or otherwise provided by After-Hours Astronomy Inc. that is caused by you or any guests you bring to AHA events. This responsibility extends to damages resulting from negligence, improper handling, failure to follow provided instructions, or any other actions contrary to AHA guidelines. However, guests will not be held liable for equipment malfunctions, damages, or failures that are determined to be the result of the actions or omissions of AHA, its employees, or contractors. In cases where liability is disputed, AHA reserves the right to make the final determination regarding the cause of damage and corresponding financial responsibility.
Environmental and Health Conditions: You acknowledge and agree not to hold After-Hours Astronomy Inc. responsible for any environmental or health conditions that may cause an event to be cancelled, postponed, or otherwise affected. This includes, but is not limited to, extreme weather conditions, natural disasters, astronomical visibility issues, environmental hazards, effects of altitude or elevation on any individual, air quality concerns, personal injuries or illnesses that occur prior/during/after an event, epidemics or pandemics, and any other circumstances beyond AHA’s reasonable control often referred to as "acts of God." Furthermore, AHA will not be held responsible for additional costs or expenses you may incur related to an event, such as airfare, hotel accommodations, automotive rentals, transportation fees, meal expenses, or any other personal travel arrangements made in connection with the event.
Weather: By agreeing to these terms you acknowledge that astronomy events are inherently dependent on environmental conditions, and AHA reserves the right to cancel, postpone, relocate, or modify any event if conditions are deemed unsafe or unsuitable for the planned activities. In such cases, AHA’s cancellation and refund policy will apply (as outlined below).
Indemnification: You further agree to indemnify and defend After-Hours Astronomy Inc and its representatives against any claims or demands related to your participation and actions at AHA events.

Technical Support Services
(1) Cancellation Policy:
All reservation purchases are valid for 1 year
Free cancellation or rescheduling with more than 24hr notice.
No cancellations or rescheduling available with less than 24hr notice.
If After-Hours Astronomy is forced to cancel a session for any unforeseeable reasons a full refund will still be issued, even if it is with less than 24hr notice.
(2) Service Guarantee

(3) Consent to use of electronic communications
By participating in events organized by After-Hours Astronomy Inc (“AHA”), you grant AHA permission to use record any video-based sessions for quality control and training purposes.
Intended Uses: Any video-based communications will be subject to possible recording or transcription, with the primary uses being further training and education. On occasion some clips may be used for promotional purposes, but the option for anonymity will always be offered in such cases.
Attribution: AHA will credit the original astrophotographer whenever feasible. If you prefer not to receive credit or not to have specific images used, please notify AHA and we will accommodate your request.
Compensation: There is no compensation or royalties for the use of any images in which your property or images may be used.
